ESi was retained to investigate an aviation crash involving airplane impacting power lines and terrain and pilot and passenger fatally injured.
Client requested an investigation into whether or not plaintiff had disclosed medical information to the FAA. The FAA medical certificate exams and medical records were reviewed and analyzed. It was discovered that the pilot had a diagnosis of Obstructive Sleep Apnea/OSA and depression which were not disclosed on FAA medical certificate exams, therefore he was deliberately falsifying his application for airman medical certificate and broke FAA regulations.
Exhibits supporting these medical diagnoses were prepared for the client to be used in mediation and the case ended in a favorable settlement.
